1. Acceptance of Terms

By accessing or using Bird Pickup & Delivery ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Bird Pickup & Delivery is a Shopify application that enables merchants to offer scheduled pickup and delivery options to their customers. The App integrates with your Shopify store to provide:

  • Date and time picker for customer checkout
  • Order scheduling and management
  • Multi-location support
  • Delivery zone configuration
  • Customer notifications (email and SMS)

3. Account Requirements

To use the App, you must have an active Shopify store. You are responsible for maintaining the security of your Shopify account and for all activities that occur under your account.

4. Subscription and Billing

The App offers various subscription plans billed through Shopify. By subscribing, you authorize us to charge the applicable fees to your Shopify account. Subscription fees are non-refundable except as required by law or as explicitly stated in our refund policy.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Interfere with or disrupt the App or servers
  • Attempt to gain unauthorized access to any part of the App
  • Use the App to transmit harmful code or malware
  • Resell or redistribute the App without authorization

6. Intellectual Property

The App and its original content, features, and functionality are owned by BirdChime Technologies and are protected by international copyright, trademark, and other intellectual property laws.

7. Limitation of Liability

To the maximum extent permitted by law, BirdChime Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the App will be uninterrupted, secure, or error-free.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these terms or for any other reason. You may cancel your subscription at any time through your Shopify admin.

10. Changes to Terms

We may modify these terms at any time. We will notify you of significant changes by posting the new terms on this page and updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the new terms.
